AskSaba (“AskSaba,” “we,” “us,” or “our”) is committed to protecting the privacy and security of your personal information—and, where applicable, the information you provide about your child. This Privacy Policy explains how we collect, use, share, and protect personal information through our services, which are primarily delivered via the AskSaba WhatsApp assistant and related tools (collectively, the “Platform”). Note: AskSaba is not a licensed healthcare provider. Any health-related information processed through the Platform is done under parental control and is not subject to HIPAA unless otherwise specified by a healthcare partner acting as a covered entity. Ask Saba is not HIPAA compliant at this stage.

1. Sources of Personal Information

We may collect personal information from the following sources:

• Directly from you, when you message AskSaba via WhatsApp, fill out a form, or otherwise contact us.
• Automatically, through tools that track usage patterns or technical data (e.g., device type, time stamps).
• From third-party services, including OpenAI, Google APIs, and messaging providers such as Twilio and WhatsApp.

2. Information We May Collect

Depending on how you use the Platform, we may collect the following:

• Identifiers: Name, WhatsApp number, email address, or other user-submitted identifiers.
• Child Information: First name, birthdate or age, developmental milestones, and any concerns or observations shared by a parent or legal guardian.
• Usage Data: Frequency of interaction, message content, AI token usage, and related analytics.
• Technical Information: IP address, device type, session logs.
• AI Tokens: Usage data based on OpenAI's token-based pricing model to process natural language inputs.

We do not knowingly collect personal data directly from children. All child-related information must be entered by a parent or legal guardian, who assumes full responsibility for accuracy and lawful sharing.

3. How We Use Personal Information

We may use your (and your child’s) data to:

• Deliver responses, reports, or suggestions through the AskSaba assistant;
• Generate AI-driven insights and summaries (using services such as OpenAI);
• Maintain usage records, track token usage, and manage billing;
• Improve Platform performance and training data (de-identified when used for internal analytics);
• Provide technical support;
• Comply with applicable law and protect legal rights;
• Communicate with you about updates or service changes;
• Personalize content and educational suggestions;
• Monitor usage for safety and quality control;
• Manage subscription plans and token billing.

We do not use personal or child information for advertising purposes.

4. How We Share Personal Information

We may share personal data as follows:

• With Providers, if you are referred by or consulting with a specialist who has partnered with AskSaba.
• With Service Providers, such as OpenAI (for AI chat generation), Twilio/WhatsApp (for message delivery), Google (for API services), Amazon AWS (for hosting), and others helping us deliver services.
• With Internal Employees, on a limited basis, to review usage and ensure quality—under strict confidentiality agreements.
• With Authorities, if required by law or to respond to a lawful request or protect safety.
• In a Business Transfer, if AskSaba undergoes a merger, acquisition, or restructuring.
• With Your Consent, when you explicitly direct us to share data with another party.

5. Use of WhatsApp and Third-Party Messaging

AskSaba operates primarily through WhatsApp, a third-party messaging platform. Communications through WhatsApp may not be encrypted end-to-end when processed by third-party systems. While we take precautions to protect your data, we cannot guarantee absolute security or privacy on external platforms. By using AskSaba on WhatsApp, you consent to the use and risks associated with these communications.

6. Cookies and Tracking (For Web Interfaces Only)

If you access any of AskSaba’s supplemental web tools (e.g., forms, summaries), cookies or similar tracking technologies may be used to enhance functionality. This includes basic analytics tools like Google Analytics and session replay for usability improvements.

7. Data Security and Retention

We use appropriate safeguards to protect your data, but no system is completely secure. Your personal information may be retained:

• As long as your account is active;
• To comply with legal requirements;
• For internal reporting, analysis, or quality improvement.

In some cases, a parent may request deletion, but we may be required to retain certain information for compliance or business needs.

8. Children’s Privacy

AskSaba is not directed to children. All child information must be submitted by an adult with legal authority. By using the Platform and entering a child’s details, you confirm that:

• You are the child’s parent or legal guardian;
• You are authorized to share this information;
• You accept full responsibility for its accuracy and lawful use.

If we learn that personal information was submitted directly by a child under 18, we will promptly delete it.

9. Your Rights and Choices

You may:

• Request access to or deletion of your data;
• Request changes or corrections to your contact or account information;
• Withdraw consent for marketing communications;
• Delete your WhatsApp history (note: this does not remove data from AskSaba systems unless you request account deletion).

Our Platform may include links to external websites or forms. We are not responsible for the privacy policies or practices of these third-party services.

11. California Privacy Rights

If you are a California resident, you may have the right under Civil Code §1798.83 (the “Shine the Light” law) to request a list of third parties with whom we share personal data for their direct marketing purposes. We may update this Privacy Policy periodically. Material updates will be posted to our documentation. Continued use of AskSaba after such changes constitutes your acceptance.
